Making Novel Arguments

When your case hinges on a legal issue that the courts have never decided—when one can’t simply look up what the law is, because there is no law as of yet—you need an attorney who will venture into uncharted territory, fashioning a novel argument and persuading the court to make new law. I never hesitate to go out on a limb for my client and present an ambitious argument that no court has yet considered.

But willingness to innovate isn’t enough. A novel argument does no good if it fails to persuade. I get results for my clients by backing up bold claims with exceptionally thorough research and thoughtful argumentation. I make it easy for courts to rule in my clients’ favor, even when that means doing what no court has done before.

Taking Cases that Don’t Fit the Mold

Attorneys often specialize in a narrow area of law, like personal injury or employment discrimination. Although specialization has its advantages, it leads many attorneys to decline cases they perceive as misfits—the cases that defy description by generic labels like “personal injury” or “misdemeanor drug possession.”
